§1 Introduction
- The purpose of these Terms and Conditions is to set forth the terms and conditions for providing services with the use of WaveJobs , an online Job Board operated under a domain name wavejobs.eu pursuant to the Act of July 18, 2002 on Rendering Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną).
- The provisions of these Terms and Conditions exclusively define the rights and obligations of the User, as well as the rights, obligations, and scope of liability of the Service Provider.
- The Service Provider provides Services by electronic means in accordance with the Terms and Conditions and applicable law.
- The Service Provider provides the User with the Terms and Conditions before concluding the contract for the provision of Services. The User is not bound by the provisions of the Terms and Conditions that have not been made available in an above-described manner. The Service Provider enables the User to obtain, restore, and consolidate the Terms and Conditions free of charge at any time.
§2 Definitions
- For the purpose of this Terms and Conditions the following definitions apply:
- Â Civil Code – means the Act of April 23, 1964 – the Civil Code (Journal of Laws of 2018, Poland item 1025, as amended).
- Account – means available to Users after logging in (entering login and password) a place on the Job Board.
- WaveJobs or Service provider – Wave General Limited Liability Company (Spółka z ogarniczoną odpowiedzialnością ) with registered office in Poland Warsaw (01-887) at 1/535 Stefana Żeromskiego str. ,  with TIN (NIP): 1182216596 , registered in the XII District Court Warsaw, Commercial Division of the National Court Register under KRS number: 0000871210, e-mail: hello@wavejobs.eu,
- Cookies – means text files saved by a web browser on a computer disk or on a User’s mobile device in order to store information used to identify the User or remember the history of actions taken by him on the Job Board.
- Candidate – means a natural person who (a) expresses the will to employ himself as an employee and submits a job application on the Job Board or will be redirected to the Employer ‘s website in order to apply for a job or (b) sets up an account on the Job Board.
- Employer – means a natural person, a legal person, or an organizational entity without legal personality running a business activity that expresses the will to employ an employee and submits a job advertisement or sets up an account on the Job Board.
- Privacy Policy – means the Policy of processing personal data available at https://wavejobs.eu/privacy-policy/
- Terms and Conditions – means these Terms and Conditions for the rendering of electronic services within the Job Board.
- Regulation or GDPR – means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
- Job Board – means Internet service run for candidates and advertiser WaveJobs at: www.wavejobs.eu .
- The Act on Electronic Services – means the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws of 2019, Poland item 123, as amended).
- The Act on Copyright and Related Rights – means the Act of July 4, 1994 on copyright and related rights (Journal of Laws of 2018, Poland item 1191, as amended).
- The Act on the Protection of Personal Data – means the Act of 10 May 2018 on the protection of personal data.
- User, Users – any natural person, legal person or entity without legal personality having legal capacity, which uses the Services provided by the Website.
- User/unregistered User – any natural person, legal person or entity without legal personality having legal capacity using the Services offered by the Websites that do not require an Account
- Works – works within the meaning of the Act on Copyright and Related Rights, which will be published by the User as part of the use of the Websites or selected Services
- The scope of services provided by WaveJobs includes (a) enabling the publication of job advertisements, (b) receiving job applications from Candidates, (c) forwarding job applications to Employer s (d) redirecting Candidates to the Employer’s online form, (e) if needed helping to form job description (f) ancillary services.
§3 Agreement for job posting
- The services are provided pursuant to the agreement concluded between WaveJobs and the Employer
- The contract for the provision of Services for the Employer may be concluded on the Website or in a different form
- Before concluding the contract, the Service Provider provides those interested in the Terms and Conditions free of charge.
- When registering, the User/Employer/Candidate :
- should provide the following data: name, surname, (name, headquarters in the case of an Employer) valid and active e-mail address and fill in all fields of the registration form, unless the field is marked as optional
- declares that the data contained in the registration form is true and does not violate any rights of third parties, and is responsible for the accuracy of the information entered in the registration form,
- The User/Employer/Candidate may terminate the registration at any time, then all previous activities aimed at creating a User Account/Employer Account/Candidate Account will be canceled.
- WaveJobs, after receiving a correctly completed Registration Form, will create a User Account/Employer Account/Candidate Account for the User/Employer/Candidate.
- The User/Employer gains access to the Account using his e-mail address and access password. The User is obliged not to disclose to third parties the password to access the Account and is solely responsible for any damage caused as a result of its disclosure
- The User/Employer/Candidate may change the account details provided during registration at any time. In the event of deletion of data, the User loses the ability to use the Website to the extent that these data are necessary to use the Services provided by the Website. If the data necessary to register the User/Employer/Candidate on the Website is deleted, User/Employer/Candidate loses the ability to use the Website.
- The User may at any time delete the account himself and the User not logged in by ceasing to use the Services.
- The Employer may, within 21 days from the conclusion of the contract for the provision of Services, withdraw from the contract without giving any reason and without incurring any costs on this account.
- The declaration of withdrawal should be submitted in writing to the address of the Service Provider:
- Wave General Limited Liability Company (Spółka z ogarniczoną odpowiedzialnością ) with registered office in Poland Warsaw (01-887) at 1/535 Stefana Żeromskiego str. ,  with TIN (NIP): 1182216596 , registered in the XII District Court Warsaw, Commercial Division of the National Court Register under KRS number: 0000871210, e-mail: hello@wavejobs.eu, A declaration of withdrawal from the contract for the provision of Services may also be submitted using the form attached to these Terms and Conditions.
- If the Service Provider becomes aware that the actions of the User/Employer/Candidate are contrary to the law, decency or the Terms and Conditions, violate the personal rights or legitimate interests of the Service Provider, after making a one-time warning and the User/Employer/Candidate’s failure to act, the service provider may block the Account. If the User’s actions are permanent, the Service Provider may block the User’s IP address or delete the account and report to the appropriate authorities.
- The Service Provider shall inform the User or the User not logged in, the Employer or Candidate (if technically possible) about the termination of the contract for the provision of Services no later than 24 hours from the date of termination.
- The Service Provider reserves the right to refuse to provide Services to the User/User not logged in/ Employer/ Candidate, including deletion of the User Account, Employer’s Account, Candidate Account if it was created again after the Account was removed by the Service Provider, resulting from a breach of the Terms and Conditions.
§4 Services for user/candidate
- The Service Provider provides the User with services consisting in making the Website available for job search.
- The User may use the services as:
- Registered User/Candidate
- in selected cases, unregistered User
- Use of services as a registered User
- To create a confirmed account, the User:
- accepts the Terms and Conditions;
- clicks on the link confirming the creation of the account, which he received to the e-mail address provided
- Before confirming the account, the User receives information about the Data Administrator and other information required in art. 13 GDPR and information that after clicking the confirmation link, the User Account is confirmed on the Website and the Agreement is concluded.
- A password is required, consisting of at least 8 characters, including at least 1 capital letter and 1 number.
- The User is obliged not to disclose the Password to a third party and bears sole responsibility for any damage caused as a result of such disclosure.
- The agreement with the User includes:
- maintaining the User Account;
- providing information about the User to the Employer, including a CV/cover letter; or other required documents
- modification of personal data by the User;
- storing information about the User in order to search for job offers for him;
- notifications about job offers
- After creating a User Account, the User may create a Profile by entering selected data concerning education, professional career, etc.
- To create a confirmed account, the User:
- A registered User may apply for a specific Advertisement by attaching CV files/cover letter/other files or through the Application with a Profile.
- After sending the Application, the User receives an automatically generated confirmation of sending the Application to the e-mail address provided by him, containing: information for which Ads he applied for.
- The registered user may select the option of consenting to the sending of commercial information by the Service Provider by electronic means (optional).
- The User has the right to object to the processing of his personal data in order to notify the Service Provider of job offers. The selected notification service is then deactivated.
- The account of a registered User is removed from the Website in case of:
- the e-mail address provided in the Registration Form prevents contact with the User;
- The User violates essential provisions of the Terms and Conditions.
- Using the Services as an unregistered User
- If the User does not have a confirmed (registered) account, the Service Provider may enable the User to use the Website Services without a confirmed User Account. In this case, an unconfirmed User Account is created on the website.
- If the User does not confirm the Account, he will receive an e-mail message encouraging him to confirm the account.
- Offer notifications
- The User may order separate Job Notification Services on the Website by clicking the icon (“Enable Notifications” or “Subscribe”) and entering an e-mail address. Under the button (“Enable Notifications” or “Subscribe”), the User becomes aware that the successful completion of the notification activation process means the conclusion of the Agreement for the provision of notification services with the Service Provider and acceptance of the Terms and Conditions.
- An automatically generated welcome e-mail with an activation link containing information about the Administrator and other information required by art. 13 of the GDPR and information that personal data provided for activation are processed in order to conclude the Agreement until the User clicks the activation link, and after clicking the link to perform the Agreement. After the User clicks on the activation link, the Notification Services are activated, which is tantamount to concluding the Agreement.
- If the User has an unconfirmed Candidate Account, at the moment of activating the Notification Service, he simultaneously activates the User Account
- User’s responsibility
- If it is found that the User is committing activities prohibited by law or the Terms and Conditions, or violating the principles of social coexistence or detrimental to the legitimate interest of the Service Provider or Employer, in particular their good name, WaveJobs may take all legally permitted actions, including limiting the use of User from the Website and the services provided through it.
- If the User uses the Website for purposes other than those indicated in §4 section 1, in particular to send information and marketing announcements to other Website Users, the Service Provider has the right to and seek compensation from the User on general terms.
§5 Services for Employer
- The Service Provider provides Services to the Employer, consisting in
- providing access to the Employer Panel in order to use certain Employer Services
- support in the field of editing and publication of advertisements
- providing access to knowledge resources
- posting Advertisements on the Website at the request of the Employer;
- distinguishing Ads in a specific way;
- placing the Employer’s presentation in the Employers’ catalog available on the Website
- providing the possibility of receiving Applications from Candidates
- the initial selection of the Application in accordance with the qualification level of the Candidates
- managing recruitment processes and Applications
- The Website services for the Employer are payable.
- Services for the Employer are provided through the Account
- An account can be created by every employer
- The Employer may have only one Account with a given e-mail address
- The creation, maintenance and liquidation of an Account is free of charge.
- Creating an Account takes place after submitting a relevant instruction by the WaveJobs service
- The creation of an Account may also take place after the publication of the announcement. In this case, the data for the Account will be taken from the advertisement
- The instruction to create an Account may be submitted by a person authorized to represent the Employer in the recruitment of employees
- Logging in to the Account is done using the login and password.
- With the help of the Account, it is possible to edit the published ads, monitor the history of submitted ads and monitor received applications
- The Employer may resign from the Account at any time by submitting an appropriate instruction by sending an e-mail to address hello@wavejobs.eu
- Account deletion will take place within 24 hours of submitting the instruction.
- The job advertisement will be available on the Website for a minimum of 30 days from the date of its publication. After 30 days, the advertisement will be removed from the Website. The advertisement is published in the first position (at the top of the list of advertisements on the Website) and will occupy further positions when new advertisements are published.
- In order to extend the service, the Advertiser should contact WaveJobs staff using an internal form or e-mail hello@wavejobs.eu or submit a new advertisement with the same content.
- WaveJobs provides a job application form for Users. After the User completes and approves the application, the application will be automatically redirected to the Employer’s e-mail address. WaveJobs will store the application for no longer than 5 weeks from the date of submitting the job application, and the application backup for 365 days from the date of receipt of the application.
- The employer may opt-out of the Job Application form and provide a link to their own form. Users will be automatically redirected to the Employer form after clicking the link to this form and after accepting it in the pop-up window displayed
- The employer has the right to independently, using the forms available on the Portal, post advertisements on the Portal, which should comply with the provisions of generally applicable law, these Terms and Conditions and good manners.
- The Employer may not, without the prior consent of the Service Provider, post on the Portal Ads from third parties, in particular entities engaged in gainful employment, employment agencies, employee outsourcing and similar.
- The Employer’s Representative may publish Announcements to the Affiliates after prior notification of WaveJobs, which may offer the Employer the provision of services tailored to his needs under separate conditions.
- The employer may not place in the Job Ads Portal, in which the headline does not correspond to the title of the position (for example, “work immediately”, “great opportunity” and similar), Advertisements concerning establishing cooperation, partnership or similar not related to the search for an employee, Advertisements discriminating against candidates under any respect. The published advertisement may refer to only one position.
- The Employer is responsible for damages caused by the use by third parties of the Login and the password to access the Portal provided by the Employer.
- The Service Provider has the right to verify the data provided during Registration by the Employer, prior and subsequent control of the content and categories of Advertisements posted on the Portal by the Employer
- The Service Provider has the right to refuse to conclude an Agreement for the provision of services if the data provided during the Registration is false, inaccurate, raise reasonable doubts as to their reliability and credibility, or is inconsistent with the Terms and Conditions.
- The Service Provider has the right to discontinue the provision of Services if the Employer’s activity on the Portal was unreliable or inconsistent with the Terms and Conditions.
- The Service Provider has the right to correct the content and category of the posted Advertisement, after notifying the Employer of any irregularities found and asking the Employer to change the content or category of the Advertisement on its own.
- In the case of an Advertisement that violates the Terms and Conditions, the Service Provider has the right to remove or amend such an Advertisement, notifying the Employer immediately.
- The Service Provider is obliged to provide all possible assistance to the Employer in the event of any problems with the use of WaveJobs services.
- The Service Provider is not responsible for the content of Advertisements posted on the Job Board
- It is forbidden to post an offer on the Portal that:
- is inconsistent with the working conditions actually offered to the candidates;
- requires the candidate to pay any fees
- is related to the night entertainment industry, or the adult entertainment industry or services
- raises suspicions of fraud
- infringes the law of the European Community
- is a direct or indirect reference of the candidate to the appropriate offer, posted on another page on the network (including – on the company’s website
- Only the following may be requested from an applicant in a job advertisement information:
- name (names) and surname,
- date of birth,
- place of residence (correspondence address)
- education,
- history of employment,
- other personal data, if providing such data is necessary due to the use of special rights provided for in the labor law,
- Personal identification number (eg. PESEL)
- The advertisement cannot be requested to provide the following information about:
- racial or ethnic origin,
- political views, religious or philosophical beliefs,
- religious, party or union affiliation,
- health, genetic code, addictions or sexual life,
- convictions, decisions on punishment and fines,
- other decisions issued in court or administrative proceedings.
- The employer is the administrator of the personal data of candidates who submitted a job application together with a CV via the advertisement form provided.
- The employer, as the administrator of the personal data of the candidates who submitted the job application along with their CV, should place the information obligation and the relevant consent clauses under the recruitment announcement forms.
- The employer ensures the implementation of appropriate technical and organizational measures so that the data processing meets the requirements of the Terms and Conditions and protects the rights of data subjects, in particular:
- application of technical and organizational measures ensuring the protection of personal data being processed, including data protection against unauthorized disclosure, unauthorized removal, damage or destruction,
- allowing the processing of personal data, including the operation of the IT system and its devices used for data processing, only to persons having an authorization issued by it,
- ensuring control over the correctness of data processing,
- keeping records of persons authorized to process personal data,
- to exercise due diligence so that persons authorized to process personal data keep them secret, also after the processing of the entrusted personal data has been completed, including by informing them about the legal consequences of violating the confidentiality of data and collecting statements on keeping the data confidential.
- Pursuant to Art. 28 GDPR, as of the date of conclusion of the contract for the provision of services, as the administrator of personal data, he entrusts the Service Provider (hereinafter: Processor) with the processing of data of candidates who have submitted an application for a job along with a CV via the provided advertisement form, in particular the data referred to in § 5 sec. 31 of the Terms and Conditions (hereinafter: Entrusted personal data), limited to the following activities: recording, storage, disclosure by sending, deletion. The Employee, as the administrator of personal data, is fully responsible for the existence of a legal basis for the processing of personal data provided to the Service Provider.
- The Service Provider undertakes to process the Entrusted personal data only to the extent and for the purpose necessary to provide the Employer with the service described in § 5 of the Terms and Conditions.
- The Service Provider ensures that the persons authorized by him to process personal data have committed themselves to secrecy and / or are subject to the relevant statutory obligation of secrecy.
- The Service Provider implements appropriate technical and organizational measures to ensure the level of security of the processing of Entrusted personal data corresponding to the risk of violating the rights or freedoms of natural persons, taking into account the state of technical knowledge, the cost of implementation and the nature, scope, context and purposes of processing, in particular:
- pseudonymization and encryption of personal data;
- the ability to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services
- the ability to quickly restore the availability and access to personal data in the event of a physical or technical incident;
- regularly testing, measuring and evaluating the effectiveness of technical and organizational measures to ensure the security of processing.
- The Service Provider takes steps to ensure that every natural person acting under the authority of the administrator or the Processor who has access to the Entrusted Personal Data, processes it only to the extent and for the purpose necessary to provide the Employer with the service described in § 5 of the Terms and Conditions, unless it requires it is subject to Union law or the law of a Member State.
- The Service Provider undertakes to support the administrator in performing the obligations set out in Art. 32-36 a GDPR.
- The service provider shall immediately inform the administrator if, in his opinion, the order given to him constitutes a breach of the GDPR or other data protection provisions.
- Any decisions regarding the processing of personal data, deviating from the provisions contained in the Terms and Conditions, should be transferred to the other party in writing, otherwise they shall be null and void.
- The service provider ensures the implementation of appropriate technical and organizational measures so that the processing meets the requirements of the GDPR and protects the rights of data subjects, in particular:
- application of technical and organizational measures to protect the processed personal data, including data protection against unauthorized disclosure, removal by an unauthorized person, damage or destruction,
- allowing the processing of personal data, including the operation of the IT system and its devices used for data processing, only to persons having an authorization issued by it, ensuring control over the correctness of data processing,
- keeping records of persons authorized to process personal data,
- to exercise due diligence so that persons authorized to process personal data keep them secret, also after the processing of the entrusted personal data is completed, including by informing them about the legal consequences of violating the confidentiality of data and collecting statements on keeping the data confidential.
- The Parties agree that during the processing of the Entrusted personal data they will closely cooperate with each other through designated contact persons, in particular Data Protection Inspectors, if appointed, informing each other about all circumstances having or likely to affect the processing of the Entrusted data. personal.
- After the end of the service, the Service Provider removes or returns to the Administrator all personal data and deletes all existing copies thereof, and is obliged to take all appropriate steps to eliminate the possibility of further processing of the Entrusted data.
§6 Payment terms
- For the provision of services, the Employer is obliged to pay the fees due for the services provided, under the conditions specified in the price list, available at: https://wavejobs.eu/pricing/ or according to separate arrangements
- The Service Provider will issue and send the Employer a VAT invoice. The Employer agrees that the Service Provider uses invoices in electronic form and receives them by e-mail (this applies to both invoices and their duplicates and corrections). However, the Employer undertakes to accept paper invoices when technical or formal obstacles prevent sending invoices by electronic means.
- The remuneration is paid by bank transfer to the bank account indicated on the VAT invoice.
- The payment date is specified in the Agreement or on the invoice
- The quoted price is a net price in EURO or in another currency. In the case of a price in another currency, the payment has to be made in this currency only. WaveJobs is an active VAT payer.
- It is necessary to pay the price to be able to publish a job advertisement on the Job Board.
- The payment may be performed with the use of:
- electronic payment (instant transfer and traditional transfer) and payment by credit card (credit and debit card) through authorized services, according to information made available on the Job Board,
- traditional transfer,
- SEPA euro payment.
§7 Responsibility
- Each party to the Agreement is obliged to compensate the other party suffered as a result of non-performance or improper performance of the Agreement, unless the failure to perform or improper performance was a consequence of circumstances for which the party is not liable, in particular as a result of force majeure.
- Neither party is liable to the other party for lost profits
- The liability of the Service Provider for the damage caused to the Employer is limited to the amount of remuneration paid by the Employer in the performance of a given Agreement.
- To the User who breaches the Terms and Conditions, the Service Provider shall not be liable for any damages resulting from the cessation of the provision of the Services/termination of the Agreement, including the removal of the User Account,
- The Service Provider is not responsible for:
- Damage caused to third parties resulting from the User’s use of the Services in a manner inconsistent with the Regulations or the law;
- Content provided by the User as a result of using the Services, which content violates the law or the rights of third parties protected by law (including works within the meaning of the Act on Copyright and Related Rights); In particular, the Service Provider does not verify the content of Employer’s Advertisements or the content of the Candidate’s CV and cover letter. Therefore, the Service Provider is not responsible for the content of these documents;
- Publishing his image on the Website by the User;
- Loss of data by the User, caused by external factors (eg failure) or other circumstances beyond the Service Provider’s control (eg third party actions), including those caused by the User;
- Damage resulting from the lack of continuity of the provision of Services, resulting from circumstances for which the Service Provider is not responsible
- Providing false, incomplete or outdated data and information by the User
§8 Complaints
- Users and the Employer have the right to submit complaints in matters regarding the Services to the e-mail address: hello@wavejobs.eu
- Complaints are considered by the Service Provider within 14 days from the date of filing the complaint.
- A correctly submitted complaint should contain at least the following data:
- designation of the User/Employer (name, surname, address, e-mail address),
- the subject of the complaint,
- circumstances justifying the complaint.
- The Service Provider will notify the User/Employer/Candidate of considering the complaint by sending a message to the e-mail address provided in the complaint.
- The right to pursue claims arising from the services provided by the Service Provider by electronic means before a common court after exhausting the complaint procedure.
§9 Amendments to the Terms and Conditions
- The Service Provider reserves the right to change the terms and conditions of using the Website Services by changing the Terms and Conditions or introducing new Terms and Conditions, in particular in the following cases:
- changes in Terms and Conditions made by authorized state authorities or issuing judgments that have or may affect the rights and obligations of the parties specified in the contract or that affect or may affect the manner of providing the Service, or regulations or rulings imposing specific obligations or granting specific powers to the parties to the contract or imposing certain obligations on third parties or tax or other regulations imposing new taxes, fees or changing the manner of their fulfillment
- changes in the technical conditions for the provision of Services, including those related to technical or technological progress,
- changes to the terms of the provision of Services by other entities,
- changes to the terms of use of the software or the use of devices used to provide the Services, made by producers or entities that have rights to the software or rights to devices,
- changes in the principles of Internet communication caused by technological progress or a decision of the authorities, or changes in the organizational principles of the Internet,
- organizational changes or legal transformations of the Website, including those which result in no legal succession,
- change of the entity providing a different service,
- formal and organizational changes on the part of the Website.
- changes to the Terms and Conditions and appendices do not change the essence of the regulations, do not affect the rights and obligations of third parties, and are treated only in a supplementary manner.
§10 Final Provisions
- The Service Provider reserves the right to:
- temporary cessation of the provision of Services due to maintenance or modification of the Website. Users will be informed about the breaks by an announcement on the Website;
- cease to provide the Services and delete the User Account, Employer’s Panel in the event of a breach of the provisions of the Regulations or breach of the law.
- In the event that the User places his image on the Website, he/she agrees to its free recording, reproduction and dissemination by the Service Provider during the period of providing the Services, in the fields of use specified in paragraph 3 – in accordance with art. 81 of the Act on Copyright and Related Rights. The Service Provider declares that the image posted by the User will be used for the proper performance of the Services.
- The User who publishes content on the Website that constitutes a work within the meaning of the Act on Copyright and Related Rights declares that he is entitled to the copyright to this work. At the same time, at the time of posting the work on the Website, the User grants the Service Provider a free, non-exclusive and territorially unlimited license, limited in time to the period of providing the Services to the User, permitting the use of the work in the fields of use: production, reproduction, public reproduction and display, introduction to memory computer and server, posting on the Internet.
- Users will be informed of any changes to the Terms and Conditions electronically to the e-mail address provided during registration.
- The Terms and Conditions are made available free of charge to all Website Users who can download, reproduce and save them via the Website.
- Any disputes that may arise in connection with the implementation of the Terms and Conditions or the Agreement shall be settled amicably. If no agreement is reached within 60 days from the date of the dispute, the case will be transferred to the court competent for the seat of the Service Provider.
- The full functionality of the job board will be delivered by December 31, 2020
